The operator and crew are the ones mainly on the hook ... top of page 21 of the regs...although this section deals with boat for hire and fin fish, the clause "including but not limited to" could have some teeth for bugs, etc. as well.
The section where a non-hunter / boat passenger could get stung is on page 23 (no exceptions, so even a minor could theoretically be cited). This section has that same all inclusive clause as above.
Poorly written regs are a concern. I have no idea how long this has been in the regs...haven't read one since about 2000 when I realized that I'd never get a lobster of legal size in season and gave up on rock scallops because there just aren't a lot of them and they can trigger a gout attack.
