why do you think the allegation is that the buddy basically "murdered" Schatz? Because divers have no duty to help other divers -- even if buddies -- unless one diver does something intentional (or reckless) that increases the inherent risks (i.e., someone disconnects a hose).

I can consent to your negligence. But I can't consent to your battery of me. Therefore my waiver would be useless.

THe whole thing is sad. I wonder what made the buddy such a target, no insurance to cover in this situation, he must be rich is all I can think of.
