You cannot ONLY illegally take, but also illegally kill. Yeah, by definition it wasn't "murder," but it was still unlawful killing of a protected animal.
"Thou shalt not commit Murder, but I think killing is acceptable. "
Not if it's against the law, which in this case, is.
