What’s the law in CA in regards to dive flags?

I’m not familiar at all with the rules in CA. Do motorboaters need a license to operate their boat? Do they have to pass a test of some sort?
What are the rules in regards to flown dive flags?
What does a boater have to face if he violates these rules without causing further harm or damage?

PS: I'm an active kayak diver and have had several boats passing by at well below 200 ft without reducing their speed. I'm kind of concerned.
