It rings a vague bell and I thought I heard the case was dismissed with prejudice (can't be refiled) as being without merit. My recollection (vague) was that there was no contract between the two, thus no obligation, and you basically can't force someone to risk their life to save someone else. But I could be wrong about all this. I'll try to check with some of my sources and see if I can get a better answer.
