If this is the same one, the article is in skin diver mag. Diving like a lot of sports (skydiving, moutain climbing, skiing...) are looked at by the courts as inherenatly dangiours, and anyone participating in them is responsable for understand this. When I was working with the mountain resuce unit here, we looked into this because of the insurance. Through many court decisions, it is hard to get a successful lawsuit against an instructor or facility, let alone a "buddy", unless that person did something that screamed negligence. However, remeber if you are the surviving buddy, you get to live with what you did or didn't do for the rest of your life. Not something I would look forward to, if I knowingly swam away from or ignored my buddy, wheather some lawyer could prove it or not.
