I understand what you're saying, except I,m not sure if I interpret 'frivolous' correctly.
In an excample, let's say I dive with a buddy and we don't have a contract. For some reason, the buddy dies during the dive, despite me having done my best to prevent it. Now his relatives sue me and loose. Is the fact that they loose enough to classify it as frivolous?
This legal system is beginning to scare me.
