As a DM you can talk to the person and advise they not make the dive. However as a DM you have no legal authority to stop them. Your only authority comes from the confidence you inspire in the divers to place in you.
The only person on a boat who can stop a diver is the Captain. He (or she) has complete authority over everything that happens by maritime law.
