You absolutely can sign away your right to litigate in a court of law.. In fact it happens every day and almost every big business has gone to it and it called ADR or Alrenative Dispute Resolution which means you can incorporate into a contract a mandatory abrbitration provison wherein you give up your right to litigate in a court of law and agree to be bound by the terms of a mediator or arbitration...
It happens every day, and trust me I was just involved in a very expensive case that litigated this very point...
