It seems to me that it was overconfidence that killed this woman. Some people would call it ego. Foregoing an ascent with your buddy when your buddy signals being out of air is a total disregard for that buddy's safety. Some people would call that selfishness. In the incident case, the sentence by Neptune for these crimes was a death penalty. I hope that when I am diving on a boat or a shore, that there is someone as skilled as Mike there to commute the death sentence that might be handed to me for similar misjudgments. But you dont meet very many divers that are that good. When you dive, the worst thing that can happen to you is that you get killed. We always forget that.
