May I respectfully suggest that you read the California Fish & Game code. Section 8599 (c) is quite clear on this:
"Any white shark killed or injured by any person in self-defense may not be landed."
If the diver acted in self-defense, no violation occured, unless the shark was landed (which it was not). DFG figured that somebody would run into a great white and have to defend themselves, and they did not want to make it a crime.
