I'm not claiming expertise in the exact statue so perhaps someone else with more expertise can jump in..
My understanding, from numerous discussions with the heads of various PADI groups is that because of some act, and I thought it was the discrimination act, that they were precluded from discrimination.. I remember VERY clearly an instructor that took a dying AIDS patient on the boat who's dying wish was to dive.. He was precluded, atleast as he represented to me, from denying a student from ENROLLING.. Notice the difference between enrollment and certification...
I'm not swearing to any of this and I'm just offering up my understanding and welcome a more authoritative point of view...
