The old 2/3's rule applies here....most claim to have been deeper than they actually have been 165 * 2/3 =110 that's a more realistic figure give than most of these 'divers' are warm water warriors who are herded by DM's that barely get them enough time to get down to eighty feet. Most people do have the stupidity or the balls to defy a DM and do a solo sortie to 165. They would loose all dive privileges at any operator I know and forefit any deposit remaining dive payments. Its smoke by the mag which is negligent by printing such an article as some cowboy right out of OW will think he/she needs to go to 165 since 35% of divers surveyed have been there. I would suggest a different method of seizure of log books at a strategic location (s) and independent verifcation of such a bs survey. I bet the numbers are a lot less than 110 for max depth for 35% divers.
