Frank, What they do is show that the buddy made an informed decision and that they acknowledged certain things including personal responsibility. Far better to be able to argue that than an implied duty care that really did not exist -- even in the buddy's mind.
You and I are likely targets if we get buddied up because we are supposed to save and protect everyone in the ocean. I treat a forced buddy as a Discover Local Diving or a Scuba Tune Up. That way I am covered by the V & B policy. They claim that they get most dismissed by the waiver. If that is true, then the rest of the world can similarly benefit by the use of waivers.
Of course I base this opinion on the fact that I am embroiled in civil litigation and therefore hate the whole legal system. And if you have a boat in the Oceanside area, be very careful where you get it worked on. You could be involved in lawsuits like me!
