Actually, you'd need to call Rick Lesser since it was his list. I agree it's rather vague and broad.
I've got a notation in my notes from the seminar that says, "More likely to be killed than just injured." My assmption would be is that since technical diving is inherently a higher-risk/less-margin-for-error application for our sport, IF there is an accident, it will more likely result in a fatality, which may be more likely to result in a suit.
And, as the oroinal thread headline states " . . . Diving Pro . . ." it refers to a training or supervisory situation, not one where you're buddied up with someone.
