The actual damages, if they could be ascertained would render the issue not worth pursuing, i'm quite sure.
The big oceanic swells do indeed stretch out the wind chop. The back of the swells are always smoother than the faces. The increase in slope angle spreads out the wind chop, so during the time the chop is on the back side of the swell, the period is increased porportion to the height of the swell. A huge swell with no wind is FUN!
