Spam is any commercial email you did not ask to receive.

If some one takes your name from a web site with a email harverster and then sends you email you don't want... that is spam.
You should not have to opt-out, any such email is by definition spam.
Sending unwanted email is bandwidth theft and should never be tolerated!
My server diver.net rejects a spam message about every 45 seconds.
Rejecting them uses bandwidth I must pay for.
Accepting them would use even more.
