You should report this vessel to the Coast Guard and follow up!! From my understanding it is absolutely ILLIGAL to harass or otherwise harm any marine mammal. I would consider shooting at the animal harassment, wouldn't you?
Also discharging a firearm with in a certain limit of the coast is illegal too. Rubber bullets can injure too which in turn can cause death it severe enough.
Please, contact the U.S. Coast Guard or the Dept of Fish & Game (I'm sure they could steer you in the right direction of exactly who to contact) and advise them of the location of the harassment, the boat name, & port of call.
