Divers:

I received the following message below in regards to opening up access at Malibu. If anyone is interested in volunteering they need folks to commit to helping out. "Access for All" was previously discussed on this BBS, so I won't go int all that information in this posting.

ACCESS FOR ALL
"opening up the California Coast"

UPDATE 11/14/02

Dear Friends,

Thank you very much for you previous support of Access for All. As you probably know, Mr. Geffen and the City of Malibu are suing us to stop us from opening a beach accessway next to Mr. Geffen's house. We would like to bring you up to date on our progress.

David Geffen & City of Malibu
Vs.
Access for All/ CA Coastal Commission/ CA Coastal Conservancy We go to court with Mr. Geffen and the City of Malibu 9:30 AM on December 6, 2002 in Los Angeles Superior Court. We are asking the judge to dismiss their complaint on the basis that the statute of limitations for actions of this type is 60 days, and Mr. Geffen has let years go by before filing his claim. Furthermore, he has taken advantage of his permits by building his house and cannot now object to the permit conditions.

There are 18 separate counts, and they include subjects as diverse as an illegal taking of Mr. Geffen's property, the constitutionality of the California Coastal Commission, and the alleged inability of Access for All to monitor and manage this site. We're confident that the majority of the case will be dismissed, but perhaps not all of it.

You have supported Access for All in the past. We need to build a volunteer base in order to convince the judge that we can handle this site management task. It's really simple. All that is required is to open the gate in the morning, close it at sundown, empty the trash barrel, and monitor the site for encroachments and litter. That means take a stroll out to the beach and look for anything amiss. That's it. AFA plans to install time-lock gates that open at sunrise and close at sunset, so all that's left is to empty the trash and to look at the site. We also need help from time to time with letters to elected officials.

We are now organizing our volunteer force and would like to know what we can count on you for. Attached is an extremely short questionnaire. Please take a moment to fill it out and help open up the California Coast for the people to whom it belongs.

Thanks,
Steve Hoye
Executive Director
