There's a hundred years of case law on that section of the California constitution. Everyone involved -- even the fishing lobbyists who will be lying to your face -- knows that there is no absolute right to fish in California. The state retains the right to regulate fishing and the ability to close some areas to fishing. There was a great article in Outdoor California (I think that's the name) a couple years ago going through the whole history behind and case law on that section... I'll see if I can't come up with it in PDF form and send it along...
