I hate to say this, but you're beginning to sound like MHK and his belief that nobody ever has heart attacks. Allowing a diver to continue to dive would not be the cause of his death. I believe if the DM explained the stupidity of running out of air and the diver understood his mistake he would not repeat it. If he argued about it or gave some lame excuse, then I would consider keeping him out of the water.
