Ken, when you say: "Basically, the properly-executed waiver removes any basis for a suit and, once basis is removed, the lawsuit is dismissed." Except when the basis is gross negligence on the part of the boat and/or skipper and/or crew and/or DM's and/or dive shop? Extremely rare when that IS the basis, of course.
What ever happened to the basis of personal responsibility when engaged in potentially hazardous activities?
