The boat captain is always ultimately responsible.

He did have a divemaster with him. Maybe the Coast Guard will find that he needs his own regular, self-trained D/M rather than relying on store-supplied D/Ms.

Or maybe the Coast Guard will find that the captain's use of store-supplied D/Ms is adequate.

We will just have to wait and see what the incident report will say. But whatever it says, yes it is true that the captain is always responsible.

It's just really a good thing the victim survived, and nobody died, this time. Thank Goodness for that.
