Luxfer says O2 > 23,5% needs O2 cleaning

Luxfer has posted O2 cleaning guidlines for their cyliders on their web site that state O2 cleaning is needed for mixes with O2 > 23.5%. This is a much more conservative standard than the 40 threshold set by OSHA and required by the rest of the SCUBA industry.
I wonder if this is driven by actual needs, or by lawyers?
