4th amendment does not apply to private individuals (very general statement), requires gov't action,. as the citation says. So if I find a pound of heroin sitting on the couch and I bring it to police (assuming I don't get buisted) they can use it against you.
If Tim finds an ab in your game bag (and try telling him he can't look in yuour game bag), he can turn you in and the evidence is admissible in any court of law.
