In the end there will probably be a settlement that the insurance will probably cover. Even if the waivers are held valid and Dan gets nothing, there is still are the legal costs.
What the insurance company pays out, they will recoup with higher rates to the boat owners, shops, DMs, etc. Thus the prices we as divers pay will also increase.
