What about his buddy who neglected to report Dan was not back on the boat? He may not be legally responsible but he has a moral obligation to report his buddy missing. Dan, the DM and Dan's buddy must all take responsibility for their errors in this incident and should all be punished justly. Captain Ray stepped up to the plate and admitted his responsibility and volunteered to take his punishment. He is an honorable and noble man in my book for his reaction and I was not surprised by his actions, having met him and been on his boat (which I will gladly do again). Rewarding Dan's many mistakes with $4M is not the answer.
