anytime as a defendant you can remove to federal court, do so. Most plaintiffs' laywers (most lawyers) are not familiar with and wouldn't like the stricter rules in fed. court, including a forced voluntary disclosure of all facts, documents and witnesses in the parties' possession.
I bet the Notice of Removal is forthcoming
