A lawyer is not the correct person to find out if there's any possibility that the rental place is at fault. An accident investigation, including gear examination, done by the authorities (police, USCG, lifeguards -- whoever had jurisdiction) is the correct place.

That said, diving is a sport of personal responsibility -- for pretty much all circumstances.
