I am not a lawyer, but I've researched this a bunch. California
law doesn't require other boats to stay any particular distance
from a dive flag, but rather to "exercise precaution commensurate
with conditions indicated."

Some other states do require particular distances and speeds.
Some other states require divers to tow a flag (not reasonable
in kelp).
