Unfortunately, handing over the photo without the © puts Manny in the position of protecting the photo for you. With the best intentions, he may have placed his © on the photo because he knew it needed to protected but did not know exactly what to do.

You should probably always make sure to hand out your photos with appropriate copyright info, just to avoid this. In this case I would have a little more than just a copyright. May something like this:

Don't hand out anything without this. And I couldn't resist rescuing a black sea bass photo while I was there.
