Keep lobster whole or risk a day in court |

That is supported by a DFG game warden in San Diego who answered a similar question with the following answer: DFG WARDEN: "Lobsters are included under the legal definition of “fish” under Fish and Game Code section 45. As far as this law is concerned, the act of bringing ashore, could include the car ride back to your house. ANY Game Warden, including myself, will cite a person in possession of tails if he or she is in a boat, on the beach, or driving away from the beach. Every person has a right to defend his or her self in court - it all depends on who the judge agrees with - the prosecutor or the defendant. Each situation is of course case by case. To be safe and to avoid potential time in court, I would advise people to keep their bugs whole until they get home." Debbie Karimoto |
