We have no law that divers be certified, although I understand the originators of the LA County program had that in mind (I may be mistaken on that point.) Diving is largely an unregulated industry. The level of regulation increases proportionately with the ability of someone dying other than the diver. Scuba is a self regulated industry. Much of that self-imposed regulation in anti-competitive rather than pro-safety, although the former is often justified in terms of the latter. Litigation is residue of that difference.
