A diver loads his tank on a charter dive boat, rigs it up with reg and BC, and the owner/skipper "secures" it to the gunnel with a bungee. Enroute to the dive site, the boat hits a large swell, the tank tears loose from the bungee, falls and smashes the BC inflator valve. Should the owner/skipper be responsible for the damage and should he compensate the diver for the smashed valve?
