It's based upon what a normal and prudent person would do in the same circumstance. I'd hazard that there are a few hundred people who would be happy to testify under oath that what you did was normal and that doing anything else would be beyond normal. LA Law, or anyone else, would have a huge hill to push the stone up to prove that you had any real liability. How about it, boat divers? Do y'all check out everybody's gear and fix set ups on your own?
