"Harshaw denied allegations of negligence and listed 14 defenses, including claiming the suit is barred by the statute of limitations".

The family's doccumented loss was June 26, 2006 the day the diver was pronounced deceased following the activity. The filing of suit was done on June 6, 2007, 345 days later. It had been less than a year since the accident before the family filed suit. The statute of limitations had not run out.
