A Redwood City man was arrested Saturday on suspicion of poaching abalone near Fort Ross State Park for the third time in less than a year, according to a state Fish and Game warden.

Mark Fresquez, 50, was booked into Sonoma County Jail in lieu of $3,000 bail.

California Fish and Game Warden Patrick Foy said Fresquez was caught Saturday with 11 abalone during the closed season. Authorities were tipped off that Fresquez intended to go abalone diving and they placed him under surveillance, Foy said.

Fresquez had been arrested in May for taking seven abalone over the limit, was convicted and placed on probation. In November, he was arrested again for having 28 abalone with another diver.

State law allows only three abalone per day to be harvested. "The guy is clearly not getting the message," Foy said.
