You can go to the DFG website and e-mail them (in detail) exactly what you are desiring to do with the DPV and ab diving. They will either e-mail you back or even give you a call with an answer...e-mail is the best answer...you then have a hard copy to printout and stow with your equipment, should it be legal and an officer questions you.
