You see Dave, the crucial aspect of your situation – invited with no strings, you cleaned up the boat, helped unload, pitched in for gas without being asked, is the critical legal aspect of the situation. When Bluewater Photo made the requirement that riders would have to pay for gas (share fuel expenses on my dive boat), he became a business (charter) selling a service.
Nobody is flinging arrows, rocks, or wads of seaweed. It was just a cautionary suggestion to a fellow diver whose idea could prove very painful and expensive if anything went wrong.
