They have to catch you in the act if it's a misdemeanor.
This is a garbage ticket, basically a strong arm robbery.
If they went and fought it they would probably get it thrown out. DFG is playing the odds they will just pay the ticket to avoid the hassle.
If they were spying with binoculars and or videoed it and/or were on the boat when the divers came up with game within an MLPA then they would have a case, but this is crap and they know it.
