Posted by Steve Lawson on August 26, 2008 at 12:06:20: In Reply to: Ticket for having game in a MLPA taken outside the MLPA posted by Chris on August 25, 2008 at 19:27:21: All three of the California Resources Codes State Marine Reserve, 36700(a), State Marine Park 36700(b), State Marine Conservation Area 36700(c) state: “…it is unlawful to injure, damage, take or possess any living, geological or cultural marine resource…” See http://www.dfg.ca.gov/mlpa/defs.asp#smr http://caselaw.lp.findlaw.com/cacodes/prc/36700-36900.html Note the inclusion of the word “possess,” which makes it a violation to have a “marine resource,” even if you are transiting a Reserve, Park, or Conservation area.
