Open access does not necessarily mean 24-hour access. Los Angeles has a midnight-to-5 a.m. curfew barring the public from beaches, piers and oceanfront parks from Will Rogers State Beach to Cabrillo Beach. Yes, the Coastal Commission is challenging the curfew, but it may get its wings clipped by the Legislature. I see no problem in closing beaches late at night. As your mother probably told you, "Nothing good happens after midnight."
