The problem is these guys doing this are in dire straits and in total desperation due to the economy. It wouldn't matter to him if you threw him in jail, he's at the end of his rope anyway.
Fines are meaningless because there is no way they can pay it and they have no intention of paying. They know that it will be difficult for the state to enforce the laws and with the budget deficit and overcrowding, fish and game violations are way down on the list of people they will spend money to lock up.

They can confiscate his gear and vehicle all they want, he will just get more gear and another car even if he has to steal one to use to get up to the coast, then dump it when he gets back to the city.

The only way to keep a character like this from poaching is to physically keep him away from the coast or water. My solution wouldn't be legal so I'll stop here.
