The quoted paragraph seems to address lobster trappers more than divers. To apply it to divers, it is illegal to bag (!) a short lobster. Divers must have a gauge on them while they catch lobster. Why would they have to have it on them if they can measure on the boat? No, bringing up short bugs with F&G on the boat means getting busted and charged. A DM should make that clear before anybody jumps in.
