Off the top of my head, I think the three were out-of-nitrox situations that resulted in embolisms. (But I don't have the report in front of me at the moment.) I believe there was one case where they said there was also a possibility of oxtox but it wasn't conclusive.

As far as your list of questions, DAN characartizes what you were breathing at the time of the death and does not imply that the gas you used casued your death. So the answer is yes, if you die breathing air/nitrox/mix you will be recorded under that particular category.
