Bob posted a link to the photo taken of the lobster with DFG's gauge showing a gap at the tail end. The least you could do, Jason, is look at the photo before getting all wound up about a "lack" of evidence.
As to why the DFG warden didn't show up to the second or third hearing, who knows. He might have forgotten, or got caught in traffic, or been sick. It's also possible that, given the tiny number of DFG wardens in San Diego, he was doing something of greater overall importance to the marine environment than sitting around a courthouse waiting.
