Copyright is just that -- the right to copy.
Jonah copied it. He did not own the copyright,
near as I can tell. That's no different from
making copies of the latest from the best seller
list.
Accreditation isn't good enough. It would have
been equally effective to say "I found a really
cool set of information about where the swells
come from and the URL is: http://www.swell.com".
Also, judges tend to also be strict
constructionists on copyright law too.
It struck me that there's one more thing that's
dive specific that wasn't mentioned: Swells cause
surge on the bottom and surf on the beach. Wind
chop does not, but makes for a miserable boat ride
or surface swim.
