I suggest you pick up a "Rules Of The Road" book.
It is called the "Line of Demarcation". It is the dividing line between U.S. Inland waters & the "High Seas" which by def, are any waters SEAWARD of the Line of Demarcation. The "High Seas" follow the International rules of the road.
A well known captain is known for saying "Admiralty law is NOT open to interpretation, it means what is says".
So get a rules book, read it, follow it.

If you want to display a symbol or light that is noted in the rules (as a Diver Down flag is unrecognized in the rules), technically a vessel engaged in diving operation can be considered "Restricted in Ability to Maneuver". Thus you can display @ night 3 lights, all around viz, top & bottom red, middle white. Day, three day shapes, the highest and lowest of these shapes balls and the middle one a diamond.
Look, stop bringing your 405 frwy "road rage" onto the water. The operator of the BottmScrach is a professional captain, he knows what he is doing better than 90+% of everone else who is out there. He is human, & being one he is open to making a decision that may not have been the best. He knows his chit.
