Not to PO you anymore, but, no taxes on any settlement. I agree, the guy sounds like a fool. But, nothing at all should in anyway mitigate(or cloud) who screwed up. I guess I'm a little shocked that in all the posts I've read the vast majority concern themselves with what a fool Dan is, instead of how the DM negligence nearly killed someone. My scenarios were to illustrate that Dan could have been anyone of us, with our own reasons for not swimming towards the boat. That whatever those reasons could have been, none mitigate the negligence of this DM. This DM may be the nicest guy in the world. He may even be well respected in his circle. But, at the end of the day, when all is said, his negligence almost cost someones life. Also, please keep in mind the DM made several repetative negligent mistakes-not merely a temporary lapse.
