I was standing right next to you when you and I asked Gina Schott of Lesser & Assoc ( the very lawyer that would likley be handling any potential litigation) and her response was that
it isn't a issue to be concerned about because as a DM in your supervisory capacity, your role in supervsing certified Nitrox divers the responsibility of the DM is fairly limited.. And since the role of a DM would be to render care in an emergency, and the care you would render is the same whether the diver is diving air or Nitrox there simply wasn't any reason for concern..
You overstate the responsibility of a DM supervising CERTIFIED divers and then invented a legal issue..
If it is of such great concern then why do the insurance companies not require it??? Why do the agencies allow it???
This happens ever day of the week and it simply isn't a compelling issue..
